Terms of Service
1. About these Terms
These Terms of Service ("Terms") are an agreement between you and iGEN Service LLC, a Georgia limited liability company that operates Racket365 ("Racket365," "we," "us"). They cover your use of racket365.com, the Racket365 app and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
Section 20 requires most disputes to be resolved by individual arbitration rather than in court or as a class action, unless you opt out.
2. Who can use Racket365
- You must be at least 13 years old. When you sign up, you tell us your age group; we never ask for your date of birth.
- If you are 13 to 17, a parent or legal guardian must read and agree to these Terms for you, and you confirm that they have. Your parent or guardian is responsible for your use of the Service.
- You must be at least 18 to register a club or organization ("Club").
- Racket365 is offered to clubs and organizations based in the United States.
- If you use the Service for a Club, you confirm that you are authorized to accept these Terms for that Club.
3. Your account
Give accurate information and keep it up to date. Keep your password private; you are responsible for activity on your account. Tell us at support@racket365.com if you think someone else has used it.
4. What Racket365 does
Racket365 provides software that Clubs use to run racket-sports activities: leagues and team leagues, schedules, scores and standings, playoffs, court and facility bookings, memberships, a club store, waivers, invitations, notifications and payments. Racket365 is a software provider. We do not organize, supervise or host any sporting activity, and we do not own or operate any facility. The Club running an activity is responsible for it.
5. Clubs
If you register or administer a Club, you agree that the Club:
- is responsible for its leagues, bookings, memberships, store, events and facilities, and for how it treats its members;
- is responsible for the member information it collects or adds, including having the right to add people and to contact them, and will use it only to run its activities;
- sets its own prices and its own refund and cancellation policies, and makes them clear to its members before they pay;
- is the seller of everything it offers through Racket365 (registrations, bookings, memberships and store goods) and is responsible for delivering it, for shipping store goods, for taxes on its sales, and for following consumer-protection and other laws that apply to it;
- is responsible for the content and legal effect of its waivers, and for having a parent or guardian sign for members under 18;
- keeps no more than seven administrators, and is responsible for what they do;
- decides whether to share a league's public pages, and shares their links only for its league activities. Participants are named on those pages only if they opt in (and, if aged 13–17, a parent or guardian approves).
6. Payments between members and Clubs
- Members pay Clubs either by card, through Stripe's checkout page, or directly (for example cash, Venmo or Zelle), as each Club allows. Money paid by card goes to the Club's own Stripe account; money paid directly goes straight to the Club. Racket365 is not a party to these sales.
- Members pay the price the Club sets, whichever way they pay. Racket365's fees and Stripe's processing fees are paid by the Club and are never added to a member's price.
- Card payments are processed by Stripe, Inc. and are subject to Stripe's terms. We never receive full card numbers.
- Refunds follow the Club's policy. Ask the Club; Racket365 cannot issue refunds on a Club's behalf or decide disputes between a member and a Club.
- If you dispute a card payment with your bank, the dispute is between you, your bank and the Club.
- Memberships are paid one period at a time and do not renew automatically. You are reminded before a period ends and can choose whether to pay for the next one.
7. Racket365's fees
- Using Racket365 is free. There are no subscriptions or plans.
- League registrations: in leagues that allow more than 25 players (including leagues with no player limit), Racket365 charges a service fee of 1% of the registration price for each registration. Leagues capped at 25 players or fewer, and free-entry leagues, have no fee. Whether a league has the fee is fixed when it is published.
- The service fee is paid by the Club; players pay only the registration price. When a player pays by card, the fee is taken from that payment. When a player pays the Club directly (for example cash, Zelle, Venmo or PayPal), Racket365 charges the service fee to the Club's card on file, combined with other fees owed. These charges are made when a league's schedule is generated and then about weekly; amounts under $0.50 carry over. The Club authorizes these charges.
- Bookings, memberships and store orders: 1% of each card payment, taken from that payment and paid by the Club. Payments made directly to the Club for these carry no Racket365 fee.
- Card processing: Stripe's own processing fees are charged to the Club by Stripe and are not part of Racket365's fees.
- If a charge to the Club's card fails, we will tell the Club's administrators and try again later; registrations are not affected, and the fees remain owed.
- When a card payment is refunded through Racket365, the matching part of Racket365's fee is returned. A service fee already charged to a Club for a directly-paid registration is not refunded. Otherwise fees are non-refundable.
- Fees do not include taxes. We will give at least 30 days' notice before changing fees.
8. Stripe accounts for Clubs
To accept card payments, a Club connects its own Stripe account. By doing so, the Club agrees to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement (together, the "Stripe Services Agreement"), as Stripe may change it. The Club authorizes Racket365 to share information about the Club and its transactions with Stripe, and to create payments, refunds and fee charges on its Stripe account through the Service. The Club is responsible for its Stripe account, including disputes, chargebacks and any amounts Stripe recovers.
9. Waivers
Racket365 lets Clubs publish waivers and collect electronic signatures. By signing a waiver electronically, you agree that your electronic signature has the same effect as a handwritten one. The Club writes each waiver and is responsible for whether it is suitable and enforceable; Racket365 is not a party to any waiver.
10. Acceptable use
Do not: break the law or others' rights; impersonate anyone; harass or harm other people; post false or misleading information; upload malicious code; try to get around security, access controls or rate limits; access other people's or Clubs' data without permission; scrape or bulk-collect data; or use the Service to send spam.
11. Your content
You keep ownership of what you upload or enter, such as names, photos, results, Club details and waivers ("Content"). You give us a limited, non-exclusive, worldwide license to host, store, display and process your Content only to operate and improve the Service, including showing it to your Club, its members and, where a Club shares a league link, the public. You confirm you have the right to provide your Content. If you send us feedback, we may use it without obligation to you.
12. Our property
The Service, including its software, design, text and the Racket365 name and logo, belongs to iGEN Service LLC and is protected by law. These Terms do not give you any right to them except to use the Service as allowed here.
13. Third-party services
The Service relies on others, including Stripe for payments. Their services are governed by their own terms, and we are not responsible for them.
14. Suspension and closing accounts
You can close your account at any time: delete it yourself under Profile → Delete my account, or email support@racket365.com. We may suspend or close an account, or remove Content, if it breaks these Terms or the law, puts others at risk, or if we are required to. Where reasonable, we will tell you first. A Club administrator can close the Club's account the same way. We then offer the Club a copy of its records and delete its information, normally within 90 days, except payment records, as our Privacy Policy describes. Anyone can also ask for a copy of their own information (Privacy Policy, section 7). After an account closes, we keep and delete information as described in our Privacy Policy. Sections 7 (for fees already owed), 11 (feedback), 12 and 15–21 continue after closure.
15. Disclaimers
Racket sports involve a risk of injury. You take part in any activity at your own risk and under the rules of the Club and facility involved. The Service is provided "as is" and "as available." To the extent the law allows, we make no warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we do not promise that the Service will be uninterrupted or error-free, or that schedules, results or other information entered by Clubs or members are accurate.
16. Limitation of liability
To the extent the law allows: (a) Racket365 is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data; (b) Racket365 is not liable for any injury, loss or damage arising from any sporting activity, event, facility, Club, waiver, or sale between a Club and its members; and (c) our total liability for all claims relating to the Service is limited to the greater of the fees you paid to Racket365 in the 12 months before the claim, or US $100. Some places do not allow some of these limits, so they may not all apply to you.
17. Indemnity
If you, or a Club you administer, cause a claim against Racket365 by breaking these Terms or the law, or through a Club's activities, sales, waivers or treatment of its members, you (or the Club) will defend and compensate Racket365 for the resulting losses and reasonable legal costs, to the extent the law allows.
18. Changes to these Terms
We may update these Terms. If a change is material, we will tell you by email or in the app at least 30 days before it takes effect. If you keep using the Service after that, the new Terms apply; if you do not agree, you can close your account.
19. Governing law
These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-law rules, except where the Federal Arbitration Act applies. Any matter not subject to arbitration will be decided in the state or federal courts located in the State of Georgia, and you and we agree to their jurisdiction.
20. Resolving disputes
Talk to us first. Before starting a claim, email support@racket365.com with a description of the problem; we will try to resolve it within 60 days.
Arbitration. If we cannot, any dispute between you and Racket365 about the Service or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, and not in court. Either of us may instead bring an individual claim in small-claims court.
No class actions. Claims may be brought only individually, not as a plaintiff or class member in any class, consolidated or representative proceeding.
Opting out. You can opt out of this section within 30 days of first accepting these Terms by emailing support@racket365.com with your name, account email and a statement that you opt out of arbitration.
This section does not apply to disputes between members and Clubs, which are for them to resolve.
21. General
These Terms and our Privacy Policy and Cookies Policy are the whole agreement between you and us about the Service. If any part is unenforceable, the rest still applies. Not enforcing a part is not a waiver of it. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of our business. Neither of us is responsible for delays caused by events beyond reasonable control.
